Terms governing your use of CallMissed.

1. Acceptance of Terms

By accessing or using CallMissed ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and CallMissed Technologies Pvt. Ltd., a company incorporated in India.


2. Description of Service

CallMissed is a multi-tenant SaaS platform that provides AI-powered communication infrastructure, including:

  • WhatsApp chatbot deployment and management
  • Inbound and outbound voice call AI agents
  • Speech-to-text (STT), text-to-speech (TTS), and LLM APIs supporting 300+ models
  • Real-time voice agent with STT → LLM → TTS pipeline
  • Conversation analytics, monitoring, and call recording analysis
  • Webhook integrations and API key management with domain whitelisting
  • Credit-based billing with prepaid top-up and plan subscriptions

3. Data Residency and Indian Infrastructure

CallMissed hosts primary production systems on Microsoft Azure data centres in India (Central India region). Customer personal data and service content are ordinarily stored and processed within India unless we notify you otherwise in writing or applicable law requires a different approach.

  • We do not sell personal data or use your content to train third-party AI models
  • Cross-border transfers, if any, are limited to what is disclosed in our Privacy Policy or agreed in writing for enterprise customers

Details of collection, security, retention, and your privacy rights are set out in our Privacy Policy. Enterprise customers may request additional contractual commitments via our Data Processing Agreement.


4. Account Registration

To use the Service, you must create an account with a valid email address and verify it via a one-time password (OTP). You may also sign in using a supported third-party identity provider when you choose that option.

You are responsible for maintaining the confidentiality of your account credentials, including passwords, API keys, and refresh tokens. You must notify us immediately at support@callmissed.com of any unauthorized use of your account.

Each account is associated with a single tenant (organization). You may invite team members with specific roles (owner, admin, agent). The account owner is responsible for all activity under their tenant, including API usage and charges incurred by team members.

By registering, you confirm that you are at least 18 years of age and that the information you provide is accurate. Where required under the Digital Personal Data Protection Act, 2023 ("DPDPA") and the Digital Personal Data Protection Rules, 2025 ("DPDP Rules"), your registration constitutes consent to processing as described in our Privacy Policy.


5. API Usage, Rate Limits, and Credits

Plan Limits

Your use of CallMissed APIs is subject to the rate limits and usage quotas associated with your plan tier. Current plan limits are published on our pricing page and may be updated with notice.

Credit System

CallMissed uses a credit-based system where 1 credit = ₹1. Each API call (LLM, STT, TTS) deducts credits from your balance. Credits are deducted before the API call is processed — if your balance is insufficient, the request is rejected with HTTP 402.

New accounts may receive promotional credits upon email verification. Additional credits can be purchased via the billing dashboard. Credits are non-transferable between tenants unless we agree otherwise in writing.

Rate Limiting

API requests are rate-limited per API key and per IP address. Authentication endpoints have stricter limits. Exceeding limits returns HTTP 429.

Model Access

Model availability depends on your plan tier. Free-tier access is limited to a subset of models; paid plans unlock the full catalog. Restrictions are enforced server-side.


6. Payments and Refunds

Payment Processing

Payments are processed through RBI-authorised, PCI-DSS compliant payment gateways. CallMissed does not store full card numbers, CVVs, or UPI PINs. We support UPI, credit/debit cards, net banking, and wallets where available. All amounts are in Indian Rupees (INR).

Plan Subscriptions

Paid plans are billed monthly unless otherwise stated. Plan upgrades take effect upon successful payment. Plan downgrades take effect at the end of the current billing period.

Credit Purchases

Credit top-ups are processed upon payment confirmation via secure verification and reconciliation processes.

Refund Policy

Refunds are governed by our Refund & Cancellation Policy and applicable consumer protection law in India, including the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.


7. API Key Security and Domain Whitelisting

API keys authenticate your requests to CallMissed APIs. You are responsible for keeping your API keys secure:

  • Never expose API keys in client-side code, public repositories, or browser-accessible locations
  • Use domain whitelisting to restrict API key usage to specific domains where supported
  • Rotate API keys regularly and revoke any compromised keys immediately
  • Enable request logging per API key to monitor for unauthorized usage

CallMissed is not liable for charges incurred due to compromised API keys that were not adequately secured by you.


8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws in India or your jurisdiction
  • Transmit harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise illegal content through our AI agents
  • Attempt to gain unauthorized access to other tenants' data or systems
  • Reverse-engineer, decompile, or disassemble any part of the Service except where permitted by law
  • Use the Service to send unsolicited communications (spam) via WhatsApp, voice calls, SMS, or email without valid consent
  • Resell API access without a written partnership agreement
  • Circumvent rate limits, usage quotas, or credit deductions through technical means
  • Manipulate or forge API request headers, origin headers, or webhook signatures
  • Use the Service to build a substantially similar competing product
  • Scrape, data-mine, or systematically download content from the Service
  • Use the Service in ways that violate applicable telecom, messaging, or AI usage regulations
  • Process special-category or sensitive personal data without a lawful basis and appropriate safeguards

We may suspend or terminate access for violations of this section or our Privacy Policy.


9. Data Ownership and Intellectual Property

Your data is yours. You retain all rights to the content you create, upload, or process through CallMissed, including bot configurations, knowledge base documents, conversation transcripts, and analytics data.

We claim no ownership over your content. We process your data solely to provide the Service and as described in our Privacy Policy.

The CallMissed name, logo, API design, documentation, and platform code are the intellectual property of CallMissed Technologies Pvt. Ltd. and are protected by applicable copyright and trademark laws.


10. Regulatory Compliance

CallMissed operates in accordance with applicable Indian law, including:

  • DPDPA 2023 and DPDP Rules 2025 — personal data protection, consent, data principal rights, breach notification, and grievance redressal
  • Information Technology Act, 2000 and rules thereunder — reasonable security practices and intermediary obligations where applicable
  • Indian Computer Emergency Response Team (CERT-In) directions — cybersecurity incident reporting and log retention where applicable to our systems
  • RBI payment framework — customer payments processed only through authorised payment aggregators/gateways
  • Goods and Services Tax (GST) and Income Tax laws — statutory retention of financial records
  • Telecom and messaging regulations — including TRAI guidelines on commercial communications where applicable to your use of voice and messaging features

You are responsible for ensuring that your use of the Service — including messages sent to your end customers — complies with laws applicable to your business, industry, and audience.


11. Service Level Agreement

We target 99.9% uptime for our API services, measured monthly. Planned maintenance windows will be communicated at least 48 hours in advance via email and our status page.

We are not liable for downtime caused by:

  • Failures of authorised infrastructure or connectivity partners outside our reasonable control
  • Force majeure events (natural disasters, government actions, widespread network outages)
  • Your own infrastructure, network issues, or misconfiguration
  • DDoS attacks or security incidents not attributable to our negligence

12. Termination

You may close your account at any time from the dashboard settings or as described in our Account Deletion Policy. We may suspend or terminate your account if you:

  • Violate these Terms or applicable law
  • Fail to pay outstanding fees for more than 30 days
  • Engage in abusive or fraudulent behavior
  • Create multiple free accounts to circumvent plan limits

Upon termination, access to the dashboard and API is revoked. Remaining credit balance may be forfeited where termination is for cause. Data handling after termination is described in our Account Deletion Policy.


13. Limitation of Liability

To the maximum extent permitted by applicable Indian law, CallMissed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, goodwill, or anticipated savings, arising from your use of the Service.

Our total aggregate liability for any claim arising from these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) ₹10,000.

Nothing in these Terms limits liability that cannot be excluded under Indian law, including liability for fraud or wilful misconduct.


14. Indemnification

You agree to indemnify, defend, and hold CallMissed, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Content generated or transmitted by your AI agents
  • Your violation of these Terms or applicable law
  • Your violation of any third-party rights
  • Unauthorized use of your API keys resulting from your failure to secure them

15. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

We do not warrant that AI-generated responses will be accurate, complete, or suitable for any particular purpose. You are responsible for validating AI outputs before relying on them for business, legal, medical, or financial decisions.


16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or dashboard notice at least 30 days before they take effect, except where immediate change is required by law or for security reasons. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.


17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Pune, Maharashtra, India, in accordance with the Arbitration and Conciliation Act, 1996.

Subject to the arbitration clause, courts at Pune, Maharashtra shall have jurisdiction.


18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
